Terms of Use

Last Updated: September 15, 2026

1. Acceptance of These Terms

These Terms of Use ("Terms") are a legal agreement between you and DURONG HOLDING (HONG KONG) LIMITED (doing business as "FibreSeek", "we", "us" or "our") governing your access to and use of the website https://usstore.fibreseek3d.com (the "Site"), your purchase and use of our products and services (the "Products" and "Services"), and your use of any related software, mobile applications, cloud printing and remote monitoring features. By accessing the Site or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site or Services.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site and Services. By using the Site or Services, you represent and warrant that you meet this requirement.

3. Accounts

• You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

• You agree to provide accurate, current and complete information and to update it as necessary.

• You must notify us immediately of any unauthorised use of your account or any other breach of security.

• We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to us or other users.

4. Orders and Pricing

All orders are subject to acceptance by FibreSeek. Prices in this United States store are in United States dollars (USD). The FibreSeeker 3 launch price is USD 2,699 per machine, compared with the regular price of USD 3,499, a saving of USD 800. The launch offer is limited to the announced launch period ending September 30, 2026 and available launch inventory.

No additional multi-unit launch discount applies. Shipping and any taxes collected by FibreSeek are shown before payment. Prices may change for future orders, but a subsequent policy or price change does not alter the terms of an already accepted order.

Machine orders are available for eligible United States and Canadian addresses. Accessories and filaments are available only for eligible United States addresses and cannot be purchased for delivery to Canada through this store. Other destination countries and unlisted United States territories are not available for online ordering.

If an order cannot be accepted, including because of an actual pricing or availability error, FibreSeek will notify you and refund any payment for the canceled order, as required by applicable law.

5. Payment

New launch orders require full payment of the checkout total in one transaction. They do not use a reservation deposit, a separate balance-payment invoice, or a four-day balance-payment deadline. Earlier orders remain subject to the payment terms agreed when they were placed.

Under the current sales plan, FibreSeek does not collect tax at checkout for Canadian orders. Please refer to the itemized checkout total for shipping and any taxes or duties collected through this store. This is not a promise of exemption from import taxes, customs duties, or carrier clearance charges; customs or carrier charges not collected at checkout may be payable separately, as explained in the Shipping and Delivery Policy.

Payments are processed through the payment providers offered at checkout. By supplying payment information, you confirm that you are authorized to use the payment method. Your rights concerning payment processing and an order refund are not excluded by the involvement of a third-party payment provider.

6. Shipping, Delivery and Risk of Loss

Shipping destinations, warehouse arrangements, applicable rates, and dispatch information are set out in our Shipping and Delivery Policy. The order-specific shipping charge and any taxes collected by FibreSeek are displayed before payment.

Dispatch and delivery are different: dispatch is handing the goods to the carrier, while delivery is arrival at the destination. Carrier transit dates may be estimates. This does not cancel an advertised dispatch commitment or any rights you have concerning delay, loss, damage, cancellation, or refund under applicable law.

Contact FibreSeek if a package is lost, damaged, or marked delivered but has not arrived. Title and risk-of-loss issues are handled subject to applicable law and any express terms agreed for the order. No provision shifts away responsibilities that cannot lawfully be excluded.

7. Returns, Refunds and Warranty

Our Limited Warranty & Return Policy sets out machine warranty coverage, the voluntary 14-day unused-product return service, the voluntary 30-day exchange service, and the applicable refund arrangements. These voluntary periods do not restrict statutory remedies for defective or non-conforming goods.

For an eligible personal-reason return after dispatch, the original outbound shipping charge is not refundable unless applicable law requires otherwise. Refunds owed because FibreSeek cannot fulfill the order, or because a statutory remedy requires them, are not excluded by this shipping provision.

Contact info@fibreseek3d.com promptly to request cancellation before dispatch. Earlier orders retain the payment and refund arrangements applicable when they were placed. Nothing in these Terms limits any non-excludable consumer rights.

8. Statutory Consumer Rights

Nothing in these Terms limits or excludes any non-excludable statutory rights or remedies you may have under the mandatory consumer-protection laws of your jurisdiction of residence.

8.1 United States

These Terms give you specific legal rights, and you may also have other rights which vary from state to state. Nothing in these Terms affects any rights you may have under the Magnuson-Moss Warranty Act (15 U.S.C. Sections 2301 et seq.) or applicable state consumer protection laws, including the California Consumer Legal Remedies Act.

8.2 Australia

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms excludes, restricts or modifies any right or remedy you may have under the Australian Consumer Law or any other applicable law.

8.3 United Kingdom

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015, including your 30-day short-term right to reject goods that are not of satisfactory quality, not fit for purpose, or not as described and obtain a full refund; your right to a repair or replacement within six months of delivery (with a presumption that a fault present within that period existed at delivery); and your right to a price reduction or final rejection where repair or replacement is unsuccessful.

8.4 Germany / European Union

Nothing in these Terms affects the legal guarantee of conformity under Directive (EU) 2019/771, as implemented in German law (Bürgerliches Gesetzbuch, BGB). The seller is liable for any lack of conformity that exists at the time of delivery and becomes apparent within two years of delivery. Where a lack of conformity becomes apparent within one year of delivery, it is presumed to have existed at the time of delivery unless the contrary is proved. Consumers in the EU are entitled to repair or replacement free of charge, and, where these are not available or fail, to a price reduction or termination of the contract.

8.5 Canada

Nothing in these Terms or the voluntary warranty, return, or exchange services limits any non-excludable rights or remedies under the applicable consumer-protection laws of your Canadian province or territory.

The Site and all content, software, designs, trademarks, logos and materials on or made available through the Site are owned by us or our licensors and are protected by intellectual property laws. No right, title or interest is transferred to you.

• Use the Site or Services in any manner that could harm us or other users.

12. User Content

If you submit reviews, comments, photos or other content ("User Content"), you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, modify and display the User Content in connection with the Site and Services. You represent that you have all rights necessary to grant this licence.

13. Third-Party Links and Services

The Site may contain links to third-party websites or services. We are not responsible for the content, policies or practices of any third party. Your use of third-party services is at your own risk.

14. Relationship with Shopify

15. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. NOTHING IN THIS SECTION LIMITS ANY NON-EXCLUDABLE RIGHTS OR GUARANTEES YOU MAY HAVE UNDER APPLICABLE CONSUMER PROTECTION LAWS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE (INCLUDING OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF OR INABILITY TO USE THE SITE, PRODUCTS OR SERVICES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APPLICABLE PRODUCT OR SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD 100 (OR THE LOCAL-CURRENCY EQUIVALENT). NOTHING IN THIS SECTION LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR FOR FRAUD OR FRAUDULENT MISREPRESENTATION. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

17. Indemnification

To the extent permitted by law, you agree to indemnify, defend and hold harmless us, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any claims, liabilities, damages and expenses (including reasonable legal fees) arising out of your use of the Site or Services or your breach of these Terms.

18. Governing Law

These Terms and any dispute arising out of or relating to them are governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to its conflict-of-laws principles. If you are a consumer, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of the country in which you have your habitual residence, and nothing in these Terms limits or excludes any rights you may have under such mandatory provisions.

19. Dispute Resolution

Any dispute arising out of or relating to these Terms shall be subject to the non-exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region. If you are a consumer, you may also bring proceedings in the courts of your country of residence.

20. Termination

We may suspend or terminate your access to the Site and Services if you violate these Terms or if we reasonably suspect fraud or unauthorised activity. Upon termination, your right to use the Site and Services ceases immediately.

21. Changes to These Terms

We may update these Terms by publishing a revised version with an updated effective date. Changes apply prospectively and do not retroactively change an accepted order or warranty rights attached to a Product already purchased. The version in effect when your order was accepted governs that order, subject to mandatory law. Continued use of the Site after an update is subject to the revised Terms to the extent permitted by law.

22. General Provisions

• Entire agreement: these Terms, together with our Privacy Policy and any policies incorporated by reference, constitute the entire agreement between you and us.

• Severability: if any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force.

• Waiver: our failure to enforce any provision shall not constitute a waiver of that provision.

• Assignment: you may not assign these Terms without our prior written consent. We may assign these Terms without your consent.
